English Abstract
Thesis summary :
The election is a process of delegating the authority and the cornerstone for establishing the
democracy in any society, through which the victors volition and wishes are reflected to elect
who represent them in the legislative authority, a process which is based on the fact the that the
people are the source of all authorities. Hence exercising this right must be genuinely conducted
to reflect the elector volition.
By considering the above , it is the state obligation, throughout its component, to safeguard and
protect the voting right and the election process through legislation and regulations, provided that
such framework, contains all the bases which establish the principle of neutrality, equality,
transparency and integrity hence ensuring their credibility to citizens and the public at large
locally and abroad.
In so far as this thesis is concerned, the researcher did not ignore the significance of effective
censorship on the election process, being one of the guarantees to ensure the election validity and
expressing the electors volition, hence the study also dealt with the mechanisms of both the
administration as a well as the judicial controls at periodic internals, to ensure the protection off
rights and the appropriate application of the law.
This study came to shed light on the legal guarantees to exercise the election right in the
kingdom of Bahrain compared with its counterparts in Egypt, Jordan, and Kuwait, with reference
to some of the legislation and judicial provisions in other countries, to make use and awareness
of such process.
At the end of this study, the researcher adopted a number of recommendations that the Bahraini
legislator should review and re-consider some of the legal texts, to develop the current elections
legislations, and promote the legal guarantees the kingdom of Bahrain enjoys.
