Abstract :
This legal study delves into the "Compensation for accidents caused by uninsured vehicles in light of the Bahraini Lawa Comparative Study". The study comprises of two chapters, preceded by an introductory one. In Chapter 1, I studied the accidents caused by uninsured vehicles, and the regulations of compensating for such. I divided this Chapter into two researches. In Research 1, I tackled the definition of vehicle accidents. In the first subject of this Research, I introduced the identification of an accident, types thereof, causes, and the ways to prevent it. In the second subject, I discussed the identification of the vehicle, provisions of its licensing and registration. In Research 2, I specified the elements of civil responsibility for the accidents caused by uninsured vehicles, and the provisions of their compensation. In addition, I divided this Research into two subjects, in the first of which I introduced the fault, the damage, and the causal connection. In the second subject, I explained the special provisions required by the Motor Compensation Fund. In order to get a compensation for accidents caused by uninsured vehicles, I concluded that it is necessary to establish the elements of civilian responsibility for the accidents caused by vehicles. Moreover, it is necessary to fulfill the special provisions required by the law of the compensation fund.
However, in Chapter 2, I studied the party responsible for paying the compensation to the victims of the accidents caused by uninsured vehicles, and the ways of assessing such compensation. I divided this Chapter into two researches, in the first of which, I mentioned the party responsible for paying the compensation. Moreover, I divided the first research into two subjects. In the first subject, I specified the party responsible for paying the compensation; namely, the one that caused the accident, his/her responsibility, and the case of having multiple parties responsible for the accident. In the second subject, I revealed the situations where the fund interfered to pay the compensation, and how to manage and finance it. In addition to the situations of recovering the compensations that have been paid. However, in research 2, 1 tackled the ways of compensation assessment. In the first subject of this research, I introduced the ways of determining the compensation, whereas, in the second subject, I studied the bases of compensation assessment. In addition to applying the rule of the loss afflicted upon the creditor and the gains he/ she missed. Furthermore, I specified the compensation assessment for the moral damages.
