Thesis summary:
The study addressed the issue of case management in the Bahrain Chamber for Dispute Resolution in accordance with the Chamber’s Law No. 30 of 2009, and its updated procedures regulations by Resolution No. 134 of 2021, in comparison with some Arab and foreign legislations, due to the importance of the cases in which the Chamber specializes due to their connection to the Kingdom’s economy and enhancing the investment environment, as well as their alignment with Bahrain’s economic vision, which is based on the principles of justice, sustainability and competitiveness.
The study addressed the understanding of the case management system in the chamber and its content, by addressing the concept of the case management system in general, then stating the formation of the case management office in the chamber, arriving at determining its scope, by stating the cases that fall within its jurisdiction. The study addressed the legal nature of the case management office, and the legal nature of its work, which falls under a jurisprudential debate about the extent to which it is considered administrative or judicial work.
The study then devoted the second chapter to examining the procedural system for managing the case in the chamber. It showed the mechanism of the office’s work in terms of the tasks of the case manager, the most important of which are preparing the case file, preparing the schedule of appointments, meeting with the opponents, and referring the case to alternative means. It also showed the powers granted to the case manager, such as the power to confirm the settlement and impose fines, indicating in this the difference in trends between the legislations, from expanding and restricting the powers and tasks of the case manager. Then the study showed the duties of the opponents in the case management stage, which are represented in attendance and submitting documents and the importance of their commitment to observing the deadlines granted to them to ensure the success of the case management.
Then the thesis concluded with a conclusion that included some results, as well as recommendations of importance to the subject of the study.
