The Thesis Summary:
It is known that the rights and freedoms of people are faced many problems at the primary investigation phase. Which may limit the human's freedom and stop his activities that are needed by the community. In addition it may discover his secrets, his personal home and his personal life will have inspection. Although all of that, the investigation may end to acquittal of the accused. As these proceedings and others will hold the accused freedom. Also, it will be mining on his home sanctity and his other rights if are used by wrong way. So, these proceedings should be done by clear guarantees to ensure the budget between the community right to get the truth and the guilty punishment, also between the man right of non-hurting his freedom and his rights.
That is the aim of the new criminal policy, and it has been confirmed by the logic which explain that the interest and justice will punish who done the crime and trying the man's rights and freedoms. Also to let the accused to defend himself.
I wrote in this thesis about these guarantees by a title of (The Accused guarantees at The Primary Investigation in The Bahraini Legislation and The Comparative). This study in depends on analytical and comparative methodology. It concentrates on comparative between the legislations of the Arab Gulf countries, Egypt, Jordan, Iraq and French. The study was divided
into four sections which was presented by introductory section. The introductory section has a historical summary about the accused guarantees during the primary investigation phase which related by the basic rules of the primary investigation.
The second section was allocated for the accused guarantees during the associated proceedings with freedom. In the third section I research about the accused decided guarantees during the proceedings of collecting evidence. At the fourth last section I wrote about the accused decided guarantees at demeaning the primary investigation.
Finally, the end of this study included the results which we have reached for and the suggested recommendations to achieve more guarantees that preserve the human's dignity and rights as an accused. In addition, which let him to prove his innocence without ignoring the community right in detecting the culprittt (criminal).
